TaleKin Terms of Service

1. Who operates TaleKin

TaleKin at talekin.co is operated by Future Insight Co., Limited, RM A1, 11/F, Winner Building, 36 Man Yue Street, Hung Hom, Hong Kong ("Future Insight," "TaleKin," "we," "us," or "our").

Before these Terms take effect, TaleKin must activate and verify privacy@talekin.co and publish a working telephone contact.

2. Who may use the service

You must be at least 18 years old and legally able to enter into a contract to create or manage a TaleKin family account. If you provide a child’s name, age, photo, voice recording, story idea, or other information, you represent that you are the child’s parent or legal guardian, or that you otherwise have lawful authority to provide that information and authorize its use as described in our Privacy Policy and Children’s Privacy Policy.

Children may enjoy TaleKin content with an adult, but may not create an account, make purchases, or bypass an adult-confirmation step.

3. What TaleKin provides

TaleKin helps families create personalized characters, stories, illustrations, audio, and related products. Features may change as the service develops. Some features may be previews, limited releases, or unavailable in a particular country.

We may suspend a feature when needed for safety, security, maintenance, legal compliance, or protection of a child’s interests.

4. Your content and permission to operate the service

You keep any rights you have in content you submit. You grant Future Insight a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, format, process, generate from, display, print, deliver, and—only at your direction—share that content as needed to operate TaleKin. We may sublicense those rights only to service providers working for us under appropriate restrictions.

This license ends when the content is deleted, except to the extent a copy must be retained by law, remains temporarily in a backup cycle, or was copied by someone you chose to share it with. This license does not transfer ownership of a child’s photo or likeness to TaleKin.

5. AI-generated content

TaleKin uses automated systems to create text, images, and audio. Outputs may be inaccurate, incomplete, unexpected, inappropriate, or similar to content generated for someone else. Please review each output before showing it to a child, sharing it publicly, or ordering a physical product.

We do not promise that an output will be unique, eligible for copyright protection, or free of third-party claims. If an output appears unsafe or inappropriate, stop using it and report it through the contact channel published with the effective version of these Terms.

6. Private by default; sharing is your choice

A child’s profile and creations are private to the family account by default. They become available to others only when an authorized adult chooses to publish them, creates a sharing link, or sends them to someone else.

A recipient may forward or copy shared material. Disabling a link can prevent future access through that link, but it cannot retrieve copies that others have already saved. Do not publish a child’s school, home address, contact details, precise location, or other unnecessary sensitive information.

7. Acceptable use

• Do not upload a child’s photo, voice, or personal information unless you have lawful authority to do so.
• Do not impersonate a parent or guardian or evade an age, consent, payment, or access-control step.
• Do not create or distribute child sexual exploitation, abuse, hateful, harassing, unlawful, privacy-invasive, or infringing material.
• Do not identify other children, scrape private content, probe security controls, reverse engineer the service for abuse, or interfere with its operation.

8. Purchases and custom products

Purchase-specific pricing, taxes, delivery, renewal, cancellation, refund, and custom-product terms will be shown before checkout. Those terms are not final until the applicable payment and fulfillment features launch.

Nothing in these Terms limits any warranty, remedy, or consumer right that cannot lawfully be waived.

9. Third-party services

TaleKin may use cloud hosting, AI generation, audio, identity, email, payment, and fulfillment providers to deliver a feature you select. Their processing of personal information is addressed in our Privacy Policy. Third-party websites and products may have separate terms that apply directly to you.

10. TaleKin intellectual property

TaleKin’s software, branding, interface, templates, and original service materials are owned by Future Insight or its licensors. Except for the limited rights needed to use the service, these Terms do not grant you rights in TaleKin’s intellectual property.

11. Suspension, termination, and deletion

You may delete individual items or request account deletion through the methods available in the service. The effective Privacy Policy will state the actual deletion scope and timing.

We may restrict or terminate access for serious or repeated violations, safety risks, fraud, unlawful conduct, or threats to the service. We will provide notice when reasonably possible and legally permitted.

12. Disclaimers and responsibility

To the extent permitted by law, TaleKin is provided on an “as available” basis. We do not guarantee uninterrupted operation or that every generated result will meet your expectations. We do not exclude responsibility that cannot legally be excluded, including liability for fraud, willful misconduct, or personal injury where applicable law prohibits exclusion.

Any limitation of liability, indemnity, or damages cap must be reviewed by Hong Kong counsel and adapted to the mandatory consumer law of the user’s country before these Terms become effective.

13. Governing law and disputes

This draft proposes the laws of the Hong Kong Special Administrative Region as the governing law and the courts of Hong Kong as the forum, subject to any mandatory consumer rights and local jurisdiction rules that cannot be waived. Qualified counsel must approve this clause before effectiveness.

14. Changes and contact

We will post the effective date and notify account holders of material changes when required. Continued use after an effective update will have the meaning allowed by applicable law; where fresh consent is required, we will ask for it.
